Update: Stamp Duty on Employment Contracts

If your employment contracts were never stamped before, don’t panic just yet. 🫣

LHDN recently issued a media statement addressing a key issue uncovered during their audits where many employers never stamped employment contracts, as required under Item 4, First Schedule of the Stamp Act 1949 (RM10 per contract).

But here’s the good news:

✅ If your contracts were signed before 1 Jan 2025

➡️ You’re off the hook! No need to stamp. No penalty.

✅ If your contracts are signed between 1 Jan – 31 Dec 2025

➡️ Still need to stamp (RM10), but no penalty if done before 31 Dec 2025.

❗️From 1 Jan 2026 onward

➡️ All employment contracts must be stamped.

➡️ Late stamping = kena penalty.

So yes, this is your warning. Go dig out those contracts. 🗂️

Happy weekend, everybody! HR folks, don’t wait till 2026 to be compliant. LHDN is watching. 👀
