Hari Raya Aidilfitri 2023 in Malaysia

Okay folks, it’s official, Raya Day 1 is going to be this Saturday, 22nd April 2023. Here are some pointers to consider when referring to the chart below:

  1. The PH Hari Raya Aidifitri is not a compulsory holiday in Malaysia. Check with your HR the gazetted public holidays in your company.
  2. Under Holidays Act 1951 Section 8, Minister (this case would be our Prime Minister) may appoint special days to be observed as additional bank or public holidays in Peninsular Malaysia or Federal Territory of Labuan. That is the the EPH all about this year on 21st April 2023.
  3. If a Public Holiday falls on an Off Day (the 6th day for a 5-days week or not applicable for a 6-days week), the company is not obligated to replace the Off Day.
  4. If a Public Holiday falls on a Rest Day (the 7th day for a 5-days week), the following day will be the replacement referring to Employment Act 1955 Section 60D(1).
  5. However, with reference to #4, if the company credits an extra Annual Leave or replace it with another day, it’s also okay.
  6. If it’s not a Normal Working Day, and you are working then the company either replace it with another day off or pay you overtime rates accordingly. I thank you for the your service to the country.
  7. And if you MIA before and after PH without prior consent from your boss, then you will not be entitled to any PH. Unless you have a reasonable excuse for such absence as stated in Employment Act 1955 Section 60D(2).
