Merdeka is Coming!
This year, Merdeka falls on a Saturday – 31st August 2024. Many have messaged me to ask whether they’re entitled to an extra off day since it’s not a working day, especially for those who work a 5-day week.
Referring to the Employment Act 1955, Section 60(D)(1), it states that if a public holiday coincides with a Rest Day, then the public holiday must be replaced on the following working day.
Now, if you work a 5-day week, you have two rest days per week. According to Section 59(1) of the Employment Act, only the last of the rest days is defined as the official Rest Day. To avoid confusion, it’s common in HR to refer to the 6th day as an Off Day and the 7th day as the Rest Day.
When a public holiday falls on an “Off Day,” it’s not mandatory for the company to replace the public holiday. So, unless your work week is from Sunday to Friday (meaning Saturday is your Rest Day), you won’t be entitled to a replacement leave on the following working day.
