The first time I had to go to JTK to attend a complaint was like some 15 years ago.
The temporary contractor left us without notice so we didn’t pay her wages in lieu of the short notice. In which she lodged a complaint against us to claim back the wages.
She said she never sign any agreement to agree on any notice period. Well, back then, our paperwork was not so tight, so not all temps will get a contract including this one.
However, during every registration, we get all candidates to sign up our registration form, and in the form the general T&C states that if you decide to quit a temp job, 5 days notice is required.
We showed the JTK officer the registration form that served as the contract. It even have the 5 days notice period marked in a circle because I always highlight that important clause during interviews for them to agree to be in our database.
That saved us from being fined. Company 1 Contractor 0.
Perhaps we got lucky that time. However the important lesson I’ve learnt, in HR, documentations always have to be cantik. Paper trail needs to be clear. Get all those paper pushed correctly, 70% of the battle is already won even if it has not started.
