Approved Annual Leave? Then you will be on Sick Leave instead and you can cancel your Annual Leave.
Reference: EA1955 Section 60E(1B) “Where an employee who is on paid annual leave becomes entitled to sick leave or maternity leave while on such annual leave, the employee shall be granted the sick leave or the maternity leave, as the case may be and the annual leave shall be deemed to have not been taken in respect of the days of which sick leave or maternity leave is so granted.”
……….
Public Holidays? Then you are entitled to a Replacement Holiday.
Reference: EA1955 Section 60D(1B) “Where any of the said ten gazetted public holidays or any other day substituted therefor as provided in subsection (1) or (1A) falls within the period during which an employee is on sick leave or annual leave to which the employee is entitled under this Act, or falls during the period of temporary disablement under the Workmen’s Compensation Act 1952, or under the Employees Social Security Act 1969 the employer shall grant another day as a paid holiday in substitution for such public holiday or the day substituted therefor.
……….
Now, if these facts are new to you, I would want to caution you. Whilst, cancelling AL when you have a valid MC is common, getting a replacement holiday when you are sick is not. In fact, when you ask for the replacement holiday, employers may view you as being too calculating.
