Shortening Notice Period

Many cheeky ones have asked, “Aunty, I don’t want to serve the full notice period, can I apply for unpaid leave for the last 2 weeks of my notice period?”

Well, if you are asking because you think applying for unpaid leave means you won’t have to pay the penalty for your notice in lieu, that’s not how it works. The law is not oblivious/stupid. If you don’t serve your full notice, then you need to pay for your notice in lieu.

The only way you can escape this is if the company agrees to waive your notice in lieu. The correct process is to submit an official request, and the company must agree to the waiver in writing.
