Dual Employment In Malaysia

So many people have asked, “Aunty, is it okay if I have two jobs? Will the company be able to find out since I have two EPF and SOCSO contributions?”

Well, in Malaysia, dual employment is not illegal. There is no law that says that you cannot have 2 jobs, and neither EPF nor SOCSO will stop you from giving them more money. And no, the company would not know unless you tell them.

At the same time, you also need to know if your company has a policy about moonlighting – moonlighting manes you having a second job in addition to your main employment. If there is such a policy, it most likely states that you need to obtain consent from the company first before taking on the second job to ensure it doesn’t effect your performance in your employment with them and that there is no conflict of interest.

Having said that, even if your company doesn’t have a moonlighting policy, I would still encourage you to be transparent about it so that you can sleep better at night. You don’t want to live in fear every day, wondering, “What if my boss finds out, can he fire me?”

And the answer to that is, it’s possible. There are many cases in court that supported termination because the employee moonlighted without consent, even though there was no moonlight policy in the company.

Anyway, if you can guarantee that it will not affect the company’s business, most of the time the company is okay with it. Honesty is always the best policy.
