POV: IRL When Justice Backfires

Sexual harassment complaints, while essential for ensuring a respectful and safe workplace, can unfortunately backfire in environments where leadership is not fully committed to addressing these issues. Sadly, these unintended consequences sometimes happen:

1. Retaliation. This can take many forms, from being sidelined for promotions to being transferred or assigned unfavourable tasks. In extreme cases, it can even result in termination.

2. Reputation Damage. In some workplaces, filing a complaint may lead to negative perceptions of the complainant. This can include whispers behind closed doors, insinuations about their motives, or being unfairly labeled as “overly sensitive.”

3. Counterclaims of Defamation. Sometimes, the accused may retaliate with legal action, claiming defamation if they believe the allegations are false.

4. Lack of Action. Perhaps the most demoralising outcome is when a complaint is ignored. Inaction signals to both the complainant and the workforce that harassment is tolerated, perpetuating a cycle of misconduct. This not only diminishes the victim’s sense of safety but also discourages others from speaking out in the future.

5. Emotional Strain. The emotional toll of filing a complaint can be immense. The stress, the fear and the emotional labour of revisiting the harassment can weigh heavily on the complainant’s mental health, potentially leading to anxiety.

While filing a complaint is important for accountability, it’s equally important to be mindful of the potential risks and prepare accordingly. My practical advice – Document everything meticulously and seek support from trusted allies.
