Decoding Employment Contracts

Our employment contract is more than just a piece of paper – it’s a crucial agreement that defines our rights and responsibilities. Here are three sections in EA1955 that shed light on our employment contract:

1. Section 2(1), a “contract of service” outlines the agreement between us and our employer. It can be “oral or in writing”, “express or implied”. It signifies the mutual commitment forming the basis of our employment relationship.

2. Section 10, however, highlights that if “a contract of service for a specified period of time exceeding one month…” exists, the contract has to be in writing and include a provision of termination.

3. Section 7 empowers us with more favourable conditions. If any term in our contact is less favourable than what the Act mandates, it’s rendered void. This section safeguards our entitlement to conditions that meet or exceed legal standards.

While there’s no exhaustive list of items the Act requires in the contract, these sections provide essential guidance.

By understanding these clauses, we can ensure that our contracts align with our legal rights. Remember, empowering ourselves with knowledge can pave the way for an employment journey filled with clarity and fairness.
