The Situation: I have received a new job offer. My notice period is 3 months but my potential employer can only wait for 1 month. They have agreed to buy out 2 months of my notice period. However, my current boss refuses to release me, stating that they need the full 3 months to find a replacement and for me to train the new person. How can I handle this?
My Thoughts:
1. This is a common situation where the employers become overly reliant on employees, and when they learn of their departure, they fear the consequences.
2. Whilst the company cannot legally prevent us from leaving, it is advisable not to burn bridges by simply leaving without discussing options for compromise. Be proactive in finding a middle ground that addresses our boss’s concerns.
3. Schedule a meeting with boss to discuss our strong desire to move on and express our commitment to ensuring a smooth transition.
4. To facilitate a smooth transition, begin by diligently documenting our work processes. Offer to provide comprehensive handover notes and assist in training a replacement during the remaining time.
5. If need be, we can also help in the search for a suitable replacement, including identifying any current talent within the company. Drawing from our experience, we are well equipped to determine the required skill set for the role.
6. Reassure our boss that even after we have left the company, we are willing to provide assistance and clarification to the new incumbent. This demonstrates our commitment to maintaining a positive relationship and supporting the company’s ongoing success.
7. If boss still refuses to let us go, it may be necessary to involve HR or higher-level management again. Explain the situation and our efforts to find a compromise, and seek their assistance in reaching a resolution that respects both our career aspirations and the company’s needs.
8. While we are it, we remind boss that due to the time constraint, it would be more feasible to encash the balance of our remaining leave instead of offsetting it with our last working day.
Throughout this process, it’s important we keep an active collaborative mindset. It will increase the chances of finding a mutually acceptable resolution. Remember, there is always a way.
